Privacy Policy
This Privacy Policy explains how Arcware, Inc. (“Arcware,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with the website at arcware.us (the “Site”). It also summarizes the privacy commitments that apply to our inference platform, including our Zero Data Retention policy. Customer use of the Arcware API is additionally governed by the applicable customer agreement.
1. Information we collect
Information you provide. When you contact us or request access through a form on the Site, we collect the information you choose to submit: typically your name, work email address, position, organization, and a description of your use case. When you email us directly, we receive your email address and the contents of your message.
Information collected automatically. When you visit the Site, our hosting and content-delivery providers automatically process limited technical data needed to serve and secure the Site, such as IP address, browser type, device and operating-system information, requested pages, referring URL, and timestamps. If we use privacy-preserving, cookieless web analytics, we receive aggregated statistics (such as page views and country-level location) that do not identify you individually.
Information we do not collect on the Site. The Site does not use advertising trackers, does not sell advertising, and does not require an account to browse.
2. How we use information
We use the information described above to: operate, maintain, secure, and improve the Site; respond to your inquiries and evaluate access requests; provide and administer the Services for customers; send communications you have requested; monitor for fraud, abuse, and security incidents; and comply with legal obligations. We do not sell your personal information, and we do not share it with third parties for their own cross-context behavioral advertising.
3. Zero Data Retention for inference
Arcware’s inference platform operates under a Zero Data Retention (“ZDR”) policy by default for all customers: prompts submitted to our inference services and the outputs generated in response are processed only as needed to complete the request, are not stored after the request completes, and are never used to train, fine-tune, or evaluate models. Transient operational metadata (such as token counts, latency, and status codes) may be recorded for billing, capacity planning, and abuse prevention; this metadata does not include prompt or output content.
4. How we share information
We share personal information only: (a) with service providers who process it on our behalf to run the Site and our business (for example, hosting, content delivery, and email providers), under obligations to protect it; (b) when required by law, subpoena, or other legal process, or when we reasonably believe disclosure is necessary to protect the rights, safety, or property of Arcware, our users, or the public; (c) in connection with a merger, acquisition, financing, or sale of assets, in which case we will require the successor to honor this Policy; and (d) with your direction or consent.
5. Cookies and similar technologies
The Site aims to function without tracking cookies. We may use strictly necessary technologies (such as those our infrastructure provider uses for security and load balancing) and local storage for basic site functionality. Because we do not use cross-site tracking, the Site does not respond differently to “Do Not Track” signals, though we honor applicable opt-out preference signals where required by law.
6. Data retention
We keep contact and access-request information for as long as needed to evaluate and manage the relationship, and business records for as long as required for legal, accounting, or compliance purposes. Technical logs are retained for a limited period consistent with security and operational needs. Inference content is governed by the ZDR policy in Section 3 and is not retained.
7. Security
We use administrative, technical, and physical safeguards designed to protect information under our control, including encryption in transit, access controls, and U.S.-hosted infrastructure that we operate and manage. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your rights and choices
Depending on where you live, you may have rights regarding your personal information, including the rights to know or access the personal information we hold about you, to correct it, to delete it, and to receive a portable copy. California residents have these rights under the California Consumer Privacy Act as amended (CCPA/CPRA); because we do not sell personal information or share it for cross-context behavioral advertising, there is no need to opt out of sale or sharing. Residents of the EEA, UK, and other jurisdictions may have similar rights under local law, and where the GDPR applies we process personal data on the legal bases of legitimate interests (operating and securing the Site), performance of a contract, consent, and compliance with legal obligations.
To exercise any of these rights, email [email protected]. We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising your rights. You may also have the right to lodge a complaint with your local supervisory authority.
9. Children
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.
10. International visitors
Arcware is based in the United States and the Site is hosted on U.S. infrastructure. If you access the Site from outside the United States, you understand that your information will be processed in the United States, where data-protection laws may differ from those of your jurisdiction.
11. Changes to this Policy
We may update this Policy from time to time. We will post the updated version on this page and revise the date above; material changes may be announced more prominently. Your continued use of the Site after an update constitutes acceptance of the revised Policy.
